Overview of H-1B

H-1B visa allows US companies to temporarily employ foreign workers in the specialty occupations that require highly specialized knowledge and a bachelor’s degree or higher in the specific specialty.   Congress mandated 65,000 regular cap and additional 20,000 master’s cap for the H-1B category per each fiscal year. Higher education institutes, Non-profit organizations associated with a higher education institutes, and non-profit research or government organizations are exempted from the H-1B cap.  The initial H-1B duration is 3 years and may extend another 3 years to continue the employment.

H-1B Eligibility Requirements

  1. US employer’s genuine demand of professional to operate the business
  2. The nature of offered position normally requires bachelor’s degree
  3. Close relationship between the nature of job duties and the professional’s studied subject

Other Visas under H visa Category

Under H visa category, there are H-1C for registered nurses (annual cap is only 500), H-2A for agricultural workers, H-2B for non- agricultural workers, and H-3 for trainee (or special education exchange visitor).  The dependent family of principle H visa workers receive H-4 visas.
