Overview of E-2 Visa

The E-2 visa classification allows a national of a treaty country to be admitted to the United States when investing a substantial amount of capital in a US business.  Certain employees of such a person or of a qualifying organization may also be eligible for this classification.

Advantages of E-2 visa

  1. Does not require US employer to sponsor the employment petition
  2. Operate a legitimated business through a relatively small amount of investment.  
  3. No maximum limit to the number of extending the same visa status in every 2 years
  4. Spouse and children under 21 years of age also can obtain E-2 dependent visa status
  5. E-2 spouse is eligible for an employment with a valid working permit.
  6. Dependent children can attend public schools in the US

Eligibility Requirements

  1. Proofs of legitimate source of investment funds
  2. At least 50% of ownership in the invested business in the US
  3. Investor’s active involvement in operation of the invested business in the US
  4. Hiring at least 2 local employees
